Terms of Service

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By using them, you represent that you meet these requirements and that the information you provide is accurate.

2. The Services

MagicStamp is a digital stamp-card loyalty platform. Consumers collect stamps at participating shops and earn rewards; merchants run loyalty programs, configure rewards, and pay a subscription. We provide the platform — we are not the seller of any goods or services offered by merchants.

3. Your account

• Consumers and merchant owners sign in with an email and password; sign-up is verified by a one-time code sent to your email. Staff sign in with a name and PIN issued by their merchant.
• You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use.
• You may delete your account at any time from the app. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are engaged in fraud or abuse.

4. Stamps and rewards

• A stamp is earned for a qualifying purchase, subject to each merchant’s program settings and daily limits. Stamps are not points and have no monetary value.
• Stamps and rewards are personal to your account, are not transferable, and cannot be exchanged for cash.
• The specific reward (e.g. a free item or discount) is defined and provided by the merchant, not by MagicStamp. Merchants are responsible for honouring their rewards.
• Merchants may correct or void stamps issued in error within a limited window. We may void stamps or rewards obtained through fraud, error, or violation of these Terms.
• In the current version, stamps and rewards do not expire; we may introduce expiry in future with notice.

5. Merchant subscriptions & billing

• Merchants pay one subscription that covers all their active locations, billed per active location for the chosen period (monthly or yearly). Current prices are shown in the Merchant app at checkout.
• Online payments are processed by Razorpay; cash payments may be recorded by our team. Your subscription term begins or extends once payment is confirmed.
• Unless required by law, fees are non-refundable. Prices and plans may change; changes apply to future billing periods.
• If a subscription is not active, a merchant’s shops and offers may be hidden from discovery and stamp/reward operations may be blocked.
• Merchants are responsible for their own content (brand, offers, reward terms), for honouring rewards, for the lawful operation of their business, and for any applicable taxes on their sales.

6. Acceptable use

You agree not to:

• Obtain or issue stamps or rewards fraudulently, or manipulate the loyalty system.
• Use another person’s account or share credentials without authorisation.
• Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorised access to the Services.
• Upload unlawful, infringing, or harmful content, or use the Services to harass others.
• Use the Services in violation of any applicable law.

7. Intellectual property

The Services, including our software, design, logos, and content, are owned by The Magic Stamp or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the apps for their intended purpose. Merchant brand names and logos remain the property of the respective merchants.

8. Third-party services

The Services rely on third parties (such as the app stores, Razorpay, Google Maps, and push-notification providers) and may link to merchant or third-party content. Your use of those services is subject to their own terms, and we are not responsible for them.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure, and we are not responsible for the goods, services, offers, or rewards provided by merchants.

10. Limitation of liability

To the maximum extent permitted by law, MagicStamp and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us (if any) in the twelve months before the claim.

11. Indemnity

You agree to indemnify and hold harmless The Magic Stamp from any claims, losses, or expenses arising out of your misuse of the Services or your violation of these Terms or applicable law.

12. Suspension & termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or for the security and integrity of the platform. You may stop using the Services and delete your account at any time. Sections that by their nature should survive termination will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for significant changes, give a more prominent notice. Continuing to use the Services after an update means you accept the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at India will have exclusive jurisdiction over any disputes arising from these Terms or the Services.
